Dee Why Salty Surf School – Terms and Conditions

By using this website, and participating at 5sports, you accept these Terms & Conditions and agree to comply with them. If you do not agree to these Terms & Conditions of use, you must not use our website or participate in any events conducted by Dee Why Salty Surf School.

General Terms & Conditions

This website and Dee Why Salty Surf School is operated by Dee Why Salty Surf School ABN 75 338 038 013 (“we, “us” or “our”) respects your privacy and is committed to protecting your personal information. These Terms & Conditions together with other information on this webpage, will inform you as to full conditions you are agreeing to.

Bookings and Payments

All transactions are processed in Australian Dollars.
 

By accessing, booking, or using any of the services provided by Dee Why Salty Surf School (hereinafter referred to as “the School”), you agree to be bound by the following terms and conditions. Please read them carefully before making any booking.

1. Bookings and Payments

• Payment Confirmation: All lessons, courses, and programs are confirmed upon receipt of full payment. Payment methods include online credit/debit card transactions or cash payments for in-person bookings.
• Non-Transferable: Lessons, courses, and packages purchased are non-transferable and cannot be assigned or gifted to another person without prior consent from the School.
  

2. Arrival and Attendance

• Check-In Requirements: All participants are required to arrive and check in at the Dee Why Surf Life Saving Club at least 15 minutes before the scheduled lesson time. Late arrivals may miss the lesson briefing, which may affect participation.
• Late Arrivals: Participants arriving after the lesson has commenced may not be allowed to join, and in such cases, no refund or rescheduling option will be provided.
  

3. Cancellations and Rescheduling

• Client-Initiated Cancellations:
  
  • Cancellations or changes to bookings must be made with a minimum of 24 hours’ notice to receive either a reschedule or a credit for future use.
  • Cancellations made with less than 24 hours’ notice will result in the forfeiture of the lesson cost, except in cases of medical emergencies with appropriate documentation.
• School-Initiated Cancellations:
  
  • The School reserves the right to cancel any lesson or course due to unsafe weather conditions, instructor unavailability, or other unforeseen circumstances.
  • In the event of a cancellation initiated by the School, participants will be contacted as early as possible and offered a choice between a full refund or rescheduling at a convenient time.
    

4. Refund Policy

• General Policy: Refunds are generally not provided for any bookings. However, in exceptional circumstances, a refund may be approved at the School’s discretion. An administrative fee of 10% will apply to all approved refunds.
• Processing Time: Refunds may take up to 30 days to be processed. Refunds will be issued to the original payment method used during booking.
• Non-Refundable Items: Bookings made using promotional offers or discounts are non-refundable.

   

5. Third-Party Bookings

• Modifications: For bookings made through third-party agents, any changes require at least 24 hours’ notice. Please contact the third-party agent directly for any amendments.
• Cancellations and No-Shows: Dee Why Salty Surf School is not responsible for managing cancellations or no-shows for bookings made through external agents. Clients should directly coordinate with their third-party provider for refunds or rescheduling.
  

6. Lesson and Hire Packages

• Non-Shareable: Lesson and hire packages are assigned to the individual purchaser and cannot be shared between multiple people unless expressly stated in the purchase terms.
  

7. Courses and Programs (e.g., 6-Week Programs, Kids’ Courses)

• Missed Lessons: Make-up sessions are not available for missed lessons within a course, program, or package.
• Medical Exceptions: If a participant misses a lesson due to illness or injury, a credit may be issued upon presentation of a medical certificate, provided that the School is informed at least 24 hours before the missed lesson.
• Non-Refundable Credits: Any credits issued are non-refundable and may only be used toward future lessons or courses at the School.
  

8. Safety and Conduct

• Swimming Ability: All participants must be able to swim at least 50 meters unassisted. Failure to meet this requirement may result in non-admittance, and no refund will be provided.
• Safety Instructions: Participants are required to follow all safety instructions provided by instructors. Any failure to comply may result in immediate termination of the lesson without refund.
• Behaviour Standards: Any behaviour deemed unsafe, disrespectful, or disruptive by the instructor may lead to removal from the lesson. No refunds will be issued in such cases.
  

9. Equipment Use and Responsibility

• Equipment Provision: The School provides all necessary equipment, including surfboards, wetsuits, and leashes, for lessons and courses.
• Client Responsibility: Participants are responsible for the care of equipment during their session. Damage caused by negligence or improper use will result in additional charges.
  

10. Liability and Waiver

• Assumption of Risk: Surfing and ocean activities involve inherent risks, including physical injury, drowning, or equipment damage. By participating, clients acknowledge and assume all risks associated with these activities.
• Waiver of Liability: Clients release Dee Why Salty Surf School, its employees, instructors, and affiliates from all liability for injury, loss, or damage arising from participation in lessons or use of equipment.
• Insurance Coverage: Participants are encouraged to obtain personal accident insurance to cover any injuries sustained during lessons.
  

11. Media Release

• Photography and Videography: The School may take photographs or videos during lessons or events for promotional and marketing purposes. By participating, clients consent to the use of their images in promotional materials.
• Opt-Out Option: If you prefer not to have your image used, please inform the instructor prior to the lesson, and your preference will be respected.
  

12. Data Protection and Privacy

• Personal Information: The School collects and securely stores clients’ personal information in compliance with relevant data protection laws. This information is used for booking, communication, and safety purposes.
• No Third-Party Sharing: The School will not share your personal information with third parties without consent, except as required by law.
  

13. Amendments to Terms and Conditions

• Dee Why Salty Surf School reserves the right to amend these Terms and Conditions at any time. Updates will be posted on the School’s website, and continued participation in lessons or use of services constitutes acceptance of any amended terms.
